The impact of the UK on trademarks after Brexit


According to current information, the UK will officially leave the EU on October 31, 2019.


There are two situations in which the Brexit trademark will occur.

1. Hard Brexit.

The EU and the UK have not yet reached an exit agreement. According to this situation, after October 31, 2019, the EU trademark will be ineffective in the UK.


2. Soft Brexit.

If an agreement can be reached between the UK and the EU, the situation becomes easier for trademark holders to respond. If an agreement is reached, there will be a transition period for the Brexit period, which will be from November 1, 2019 to December 31, 2020. If there is any situation, the transition period may be extended by another one to two years.

Then the EU trademark will naturally continue to be protected to the UK during the transition period.


What is the current status of registration of EU trademarks?

EU member countries currently have 28 countries, and registered EU trademarks are valid in the UK before the official exit of the UK. After the Brexit, EU trademarks will continue to be valid in the remaining 27 EU member states.
